Burberry v. TJ Maxx – Copy of the “Burberry Check”

JusticeNewFlash reports that Luxury fashion house Burberry, filed a trademark infringement lawsuit against off-price stores.

New York business litigation lawyers alert- Burberry filed a trademark infringement lawsuit against TJX Cos for counterfeit products.

British fashion company, Burberry, has filed a trademark lawsuit in U.S. District Court in the Southern District of New York against the popular US off-price retail stores TJ Maxx, Marshalls and HomeGoods. All three stores are operated by TJX Cos.

Burberry accuses TJX Cos. of trademark infringement. According to Burberry, all three stores have been selling counterfeit Burberry products for a period of four years. The famous Burberry pattern was sold on jackets, picture frames, polo shits, scarves and luggage.

Burberry is famous for their “Burberry Check,” which is a pattern consisting of a cross-hatched design using camel, red, black and white.

Burberry is seeking to stop the sale of the infringing products, the destruction of unauthorized products, a requirement that TJX make “corrective advertisements,” triple damages and other various corrective measures.
